为保障您（以下简称“用户”或“您”）的合法权益，并明确您使用 Red Scarf（以下简称“Red Scarf”或“我们”）网站、论坛及相关服务时的权利与义务，我们特制定并更新本《用户协议》（以下简称“本协议”）。
本协议适用于 https://www.honglingjin.co.uk/ 网站、其附属社区功能，以及 Red Scarf 在微博、微信、Facebook、Instagram、Twitter/X 等社交媒体官方账号的互动内容（以下统称为“网站与论坛”）。
使用网站与论坛即表示您已阅读、理解并同意遵守本协议及其不时更新的条款。如您不同意本协议的任何内容，请立即停止使用相关服务。Red Scarf 保留随时修改本协议的权利，修改内容自发布时起生效。

用户无需注册账户即可访问并使用 Red Scarf 的网页版。
凡访问、浏览或使用 Red Scarf 网站及论坛的用户，即视为同意遵守本协议的相关条款。
如用户同时使用 Red Scarf App 账户，则须符合以下条件，并在此声明与保证：
您可在网站与论坛发布/上传/展示文本、图片、音视频、链接、评论、头像昵称、标签、以及 AI 生成/合成内容等（统称“用户内容/UGC”）。
您对用户内容独立承担全部法律责任，包括其合法性、准确性与不侵权性。网站与论坛上的用户内容仅代表发布者个人观点，不代表 Red Scarf 立场。
您承诺不得在 Red Scarf 网站或相关服务中发布、传播或存储以下内容：
为提供、运营及改进 Red Scarf 的各项服务，您授予 Red Scarf 在服务相关范围内，对您上传或发布的用户内容享有全球范围、非独占、免版税、可再许可的权利，以便进行使用、复制、改编、展示、分发及备份等操作。
该授权仅限于服务运营所需，不构成对内容所有权的转移。
Red Scarf 有权根据适用法律及本协议的约定：
Red Scarf 将在合理范围内，努力平衡用户的表达自由与平台秩序及他人合法权益的保护。
网站和论坛将向用户呈现第三方优惠券、交易、广告和其他优惠（以下统称“要约”）。要约是由第三方（以下统称“卖方”）提供的产品和服务。用户选择接受要约，则视为与卖方达成交易。Red Scarf并非交易相关方，因此不对用户和卖方之间的交易承担任何责任。Red Scarf不负责履行任何要约。

Red Scarf为用户免费提供在线优惠券服务。对于在线优惠券的赎回、错误/疏忽或过期等情形，Red Scarf不承担任何责任，用户应自行确保卖方结帐过程中是否有折扣、特价或免费赠予等情形。网站和论坛上的所有要约和推广内容如有变更，恕不另行通知。Red Scarf无法控制卖方提供的任何优惠券或其他要约的合法性、任何卖方按照要约完成销售的能力、以及卖方所提供商品的质量。Red Scarf无法控制卖方是否会遵守网站和论坛上所示的要约，也无法保证网站信息的准确性和完整性。对于用户就网站和论坛、或网站和论坛上的信息使用与卖方发生的任何争议，用户同意放弃提出索赔、要求、诉讼、损害赔偿（直和间接）、损失赔偿、成本赔偿、或已知和未知或已披露和未披露费用赔偿的权利，并免除Red Scarf就此所承担的责任。

用户同意补偿并确保红领巾、其母公司、子公司、关联方、管理人员、董事和雇员免于承担任何第三方就用户使用网站和论坛、用户违反本协议的条款和条件，或用户或用户账号的其他使用者侵犯任何用户的帐户或任何知识产权或任何个人或实体的其他权利，或因任何成员通信中包含任何恐吓、诽谤、淫秽、盗用或侵权材料而提起的任何索赔或要求，包括合理的律师费和开支。
本协议的“条款和条件”可能随时发生变更；红领巾将在本页发布变更信息。用户同意接受上述所有“条款和条件”的约束，包括更新后条款和条件。因用户未了解相关变更而造成的任何后果，红领巾不承担任何责任。用户应定期访问本页面，以确定本协议是否发生了修改或变更。如果用户不同意对本协议的任何修改，应立即终止用户名、密码和注册，并停止使用所注册帐户。
用户同意遵守所有适用的法律、法规和条例。用户可在法律、法规和条例允许的范围内参与网站和论坛。用户有下列情形之一的，红领巾有权拒绝注册或限制、修改或终止其用户名、密码和注册，且无需就此向用户或任何其他第三方承担任何责任：用户违反任何法律、法规和条例的；用户的参与可能导致违反任何法律、法规和条例的。
用户特此确认，网站和论坛的内容，包括但不仅限于红领巾、红领巾的广告商、销售商或其他相关方所提供的文字、声音、图片、图形和其他材料以及服务和软件等，均受版权、商标、服务标志、专利和/或其他专有权和法律的保护。用户获得红领巾、红领巾的广告商、销售商或其他相关方的明确授权后方可使用相关内容、服务或软件。用户特此确认，网站和论坛的所有知识产权归红领巾或其许可方所有。网站和论坛的提供，不得视为向用户或任何第三方转让涉及该知识产权的任何权利、所有权或权益。
我们依照《隐私政策》处理个人数据与追踪技术。
举报、申诉与内容审核过程中产生的联系方式、证据、日志与处理记录，仅在履行法定义务、争议解决与合规审计所必需期间保存，之后将删除或匿名化。

Red Scarf 作为信息社会服务提供者/托管服务提供者（hosting provider），依照英国 Electronic Commerce (EC Directive) Regulations 2002（“ECR 2002”，特别是第19条）、Defamation Act 2013（第5条：网站运营者抗辩）、UK GDPR 与 DPA 2018、以及（如适用）Online Safety Act 2023 的要求建立通知—处置机制。
要点：在收到有效通知后及时移除或限制访问，可构成平台责任豁免/抗辩的重要基础。
若您认为网站与论坛内容涉嫌违法/侵权，请通过以下任一方式提交有效通知：
有效通知应包含：
获悉涉嫌违法/侵权内容后，我们将基于内容性质与紧急程度及时采取合理措施（含限制访问或移除），并向发布者发出“理由说明”（Statement of Reasons）与申诉渠道。
被采取限制或移除措施的用户，可在 14日 内通过 [email protected] 或 App 内意见反馈发起申诉并补充材料。我们将在合理期限内完成复核；如属误判，将予以恢复并记录。
如同一账户两次及以上被确认存在有效侵权/违法内容，或一次性质特别严重的违法侵权，我们可对该账户采取内容删除、功能限制、冻结或终止账户、限制设备或IP等措施，并在必要时配合权利人或执法机关。
对恶意或明显不实的重复举报，我们可限制其举报功能或采取相应措施。
除非法律另有强制要求，您同意我们通过网站通知、站内信、系统弹窗或您提供的电子邮箱向您送达与本协议及执行有关的各类通知与说明。
红领巾与网站和论坛上的信用卡发卡机构部分附属项目存在经济往来。红领巾在网站和论坛发布的相关内容并非由信用卡发卡机构提供或受其委托。红领巾在网站和论坛发表的相关意见不得视为信用卡发卡机构的意见，也未经信用卡发卡机构审核、批准或以其他方式进行背书。
红领巾未行使本协议项下任何权利或未执行本协议任何条款，不构成对该等权利或条款的放弃。
本协议受 英格兰与威尔士法律（England & Wales law） 管辖，并据其解释。因本协议引起或与之相关的任何争议，由 英格兰与威尔士法院 专属管辖（不影响您作为消费者在常居地享有的强制性权利）。
本协议的任何条款（或条款部分内容）被认定为无效、非法或不可执行的，该条款仅在该禁止和不可执行的范围内无效，而不会致使本条款的其余部分或本协议的其余条款失效。在适用法律允许的前提下，本协议各方特此同意放弃导致本协议条款在任何方面无效、非法或不可执行的法律条款。

To protect your legal rights (“you” or “the user”) and to clarify your rights and obligations when using Red Scarf (“Red Scarf,” “we,” or “us”) website, forum and related services, we hereby formulate and update this User Agreement (“Agreement”).
This Agreement applies to the https://www.honglingjin.co.uk/ website, its community features, and interactive content published via Red Scarf’s official accounts on Weibo, WeChat, Facebook, Instagram, Twitter/X (collectively referred to as “Website and Forum”).
By accessing or using the Website and Forum, you confirm that you have read, understood, and agreed to be bound by this Agreement and its updates. If you do not agree to any part of this Agreement, please stop using the services immediately. Red Scarf reserves the right to amend this Agreement at any time. Updated terms take effect upon publication.
To protect minors, you must be at least 13 years old to use the Website, Forum, and related services. Where applicable, we will comply with the Age Appropriate Design Code (UK Children’s Design Code) in our product and data protection practices.
You may access and use the Red Scarf website without registering an account. By accessing, browsing or using the Website and Forum, you are deemed to have accepted the terms of this Agreement.
If you also use a Red Scarf App account, you represent and warrant that:
You may upload, post or display text, images, audio/video, links, comments, usernames, tags, and AI-generated or synthetic content (collectively, “User Content”) via the Website and Forum.
You are solely responsible for the legality, accuracy, and non-infringing nature of your User Content. User Content reflects the opinions of the individual poster and does not represent Red Scarf’s views.
You agree not to post, share, or store any of the following:
To provide, maintain and improve our services, you grant Red Scarf a global, non-exclusive, royalty-free, sub-licensable licence to use, copy, adapt, display, distribute and back up your uploaded or published content for service-related purposes only. This licence does not transfer ownership.
Red Scarf reserves the right to:
We will make reasonable efforts to balance freedom of expression with legal obligations and community safety.
The Website and Forum display third-party coupons, deals, advertisements and other offers (“Offers”). Offers are provided by third-party vendors (“Merchants”). By choosing to redeem or accept an Offer, you are entering into a transaction with the Merchant, not Red Scarf. Red Scarf is not a party to such transactions and assumes no responsibility for their performance.
Before purchasing or engaging with any Offer, please review its full description, including any additional terms and conditions listed on the Merchant’s website. You are solely responsible for assessing the product or service and complying with the Merchant’s refund or cancellation policy. These policies are not governed by Red Scarf.
In all cases, Red Scarf shall not be liable for any loss or damage arising from transactions between users and Merchants. For any issue related to an Offer or a transaction, please contact the Merchant directly.
Red Scarf offers free access to online coupon services. Red Scarf is not responsible for any failure to redeem, errors, omissions, or expiry of coupons. It is your responsibility to confirm discounts or offers at checkout on the Merchant’s platform.
All Offers and promotions are subject to change without notice. Red Scarf has no control over the legality, availability, or fulfilment of any Offer, nor the quality of goods/services involved. We do not guarantee the accuracy of any Offer displayed.
By using the Website and Forum, you agree to waive and release Red Scarf from any and all claims (known or unknown), including but not limited to direct, indirect, or consequential damages or losses arising from your interaction with Merchants.
The Website and affiliated social media accounts are provided on an “as-is” and “as-available” basis. To the maximum extent permitted by law, Red Scarf disclaims all warranties, express or implied, including but not limited to merchantability, fitness for a particular purpose, or non-infringement.
We do not guarantee uninterrupted or error-free access to the Website or Forum. Red Scarf is not liable for any damages resulting from your inability to access or use the platform, including but not limited to missed discounts or unredeemed coupons.
Under no circumstances shall Red Scarf, its officers, directors, employees, affiliates, agents, or representatives be liable for any compensation, incidental, indirect, special, consequential, or punitive damages—even if advised of the possibility.
You agree to indemnify and hold harmless Red Scarf, its affiliates, directors, and staff from any third-party claims or demands arising from your use of the Website or Forum, your breach of these terms, or your infringement of any rights.
These terms may be amended at any time. Updates will be published on this page. You agree to be bound by all updates. Red Scarf is not responsible for your failure to review changes. If you disagree with any amendments, you must stop using the services immediately.
You agree to comply with all applicable laws and regulations. If your participation violates any law or poses legal risk, Red Scarf reserves the right to suspend or terminate your account without liability.
All content on the Website and Forum—including but not limited to text, graphics, software, services and media—is protected by copyright, trademark, patent, and other laws. All intellectual property belongs to Red Scarf or its licensors. No transfer of ownership is implied.
You may only use content or software with express written permission.
Red Scarf operates as a hosting provider under the UK Electronic Commerce (EC Directive) Regulations 2002 (esp. Regulation 19), Defamation Act 2013 (Section 5), UK GDPR, DPA 2018 and, where applicable, the Online Safety Act 2023.
Upon receiving valid notice, we may remove or restrict access to content in line with liability exemption protocols.

Red Scarf will assess the notice based on urgency and content type. We will take appropriate action and send a Statement of Reasons and appeal procedure to the uploader if applicable.
Affected users may appeal within 14 days by email（[email protected]） or via in-app feedback. We will review the case and reinstate content if incorrectly removed.
Accounts found to have two or more confirmed violations—or one severe breach—may be suspended, blocked, or terminated. Device or IP restrictions may apply. We will cooperate with rights holders and authorities when necessary.
We reserve the right to limit the reporting function for users who submit malicious or clearly unfounded complaints.
Unless legally required otherwise, you agree to receive all notices relating to this Agreement via website banners, inbox messages, popups, or the email address you provided.
Some promotions involve financial relationships with credit card issuers. Red Scarf is not acting on behalf of nor endorsed by such issuers. Views expressed do not represent or reflect the opinions of any credit card provider.
Failure to enforce any part of this Agreement does not constitute a waiver of Red Scarf’s rights.
This Agreement is governed by the laws of England and Wales. Disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales (without affecting mandatory consumer rights in your jurisdiction).
If any provision (or part of a provision) is found to be invalid or unenforceable, the remaining provisions will remain in full force. Parties agree to waive enforcement of any unlawful clause to the extent permitted by law.
